Nadler Files Amicus Brief in Support of Mifepristone Access

Today, Congressman Jerrold Nadler (D-NY), Ranking Member of the House Judiciary Committee, and 239 Democratic Members of Congress filed an amicus brief in the case Alliance for Hippocratic Medicine v. Texas in support of access to Mifepristone, a FDA-approved drug for use in medication abortion care and miscarriage treatment.  

Along with fellow Members of the Pro-Choice Caucus, Congressman Nadler took emergency action in filing the brief after a Trump-appointed Judge issued an unprecedented order to suspend FDA approval of a drug that remains safe and effective, just as it was when first approved by the FDA over 20 years ago. 

"Make no mistake, this is yet another step in Republicans’ march toward a nationwide abortion ban,” said Ranking Member Nadler. “Undermining the FDA’s rigorous approval and scientific review process to advance their craven political agenda demonstrates Republicans’ willingness to stop at nothing to strip Americans of their right to make their own medical decisions.” 

“While Mifepristone continues to be legal and accessible for those who need it, if this decision were allowed to stand, access would be severely restricted, even in states like New York where the right to abortion is protected. Congress empowered the FDA’s experts to follow a rigorous approval process under the Food, Drug, and Cosmetic Act, and I do not believe the plaintiffs in this case have standing to invalidate the approval of a longstanding drug over the FDA’s objections.”
